Continued use of this site or downloading images binds you to the terms of this agreement. Copyright Notice Rights Protected Images All images are the copyrighted property of Picture Finders Limited. Beyond the following “grant of rights” it is prohibited and a violation of copyright law to use or copy any image, or part of any image, from this site in any form without permission from Picture Finders Limited. “Comp.” / Layout usage rights If you are genuinely and potentially interested in purchasing the rights to use an image you may for the purpose of client presentations and inspections use thumbnails and low resolution images in comprehensive layouts (“comps”). This right is granted for a period of 30 days after which you must destroy the digital file and any copies or derivatives of it. Other than this usage you may not use any image in any way until an invoice indicating your rights to use the image is paid in full. Usage of any image beyond the rights granted above constitutes willful copyright infringement. Purchasing Rights Upon receipt of a confirmed payment Picture Finders Limited will grant you a non-transferable right to use the image within the use category selected and agreed upon. You are not permitted to use the image or portions of the image in any other way. Restrictions on use You must comply with all intellectual property laws. You must not use the image or any part of it in a manner that is defamatory libelous, pornographic, fraudulent or violating any laws or violating any persons rights of privacy or publicity. You cannot copy, rent, transfer or grant any rights to the images or derivatives or other work containing the images to other persons or organizations without prior consent from Picture Finders Limited. You cannot place any image online in any downloadable or ftp format. Warranty / Liability The images are guaranteed to be usable when handled correctly. Under no circumstances will Picture Finders Limited be liable for any damages whatsoever arising out of the use of or inability to use the images or the inability to obtain additional rights to the images. The limit of liability of Picture Finders Limited is to refund the price paid for the image use. This is subject to the non-use and return of the image and termination of this agreement. Infringement Picture Finders Limited will be entitled to a compensation fee equal to US$1,500 or an amount equivalent to ten times (10X) the contract amount whichever is higher, for any unauthorized use by you of any image. Return of Digital Files Digital Files may be retained for sixty days or until the date indicated on the invoice or otherwise as agreed to in writing. After this time all unlicensed digital images (copies and derivatives) must be deleted and destroyed and films must be returned. Disclaimers Whilst every reasonable effort is made to ensure accuracy, we make no representations or accept any responsibility as to the accuracy, correctness, completeness or quality of the contents of this site. Further, we make no representations or accept any responsibility that the functional aspects of this site will be error free, virus free or uninterrupted. Picture Finders Limited will not be liable for any general, special, direct, indirect, consequential, incidental, or other damages arising out of the rights granted herein. Referrals and Links As a convenience our site links to other sites. We are not responsible for the availability of or any content contained in any linked site. Privacy Information Picture Finders Limited respects your privacy rights. We will not share any information collected on this site without your written permission except as required by law. Releases All endeavors are made to ensure that identifiable people are “Model Released “ In most cases images on the site are labeled “Model Released” in “keywords” when a release is available. However images are assumed to be “not released “ unless releases are expressly acknowledged by Picture Finders Limited in writing. If an error is made regarding releases Picture Finders Limited’s liability will be limited to the amount you paid for the image usage. You agree to indemnify Picture Finders Limited against all claims arising out of the use of any image where the existence of any release has not been acknowledged in writing by Picture Finders Limited. Picture Finders Limited makes no representation or warranty with respect to the right to use names, content, images, trademarks, logos, designs, or art depicted in any image. You must satisfy yourself that all rights, consents and permissions that may be required for reproduction are secured. Legal Validity The “Terms and Conditions” are regarded as part of this internet site. If sections or individual terms are not legal or correct the validity of the other parts remain unaffected. Juristriction The interpretation of this contract shall be governed by the laws of Hong Kong. Should there be case to go to court, you agree to reimburse Picture Finders Limited reasonable legal fees plus legal interest on any award. Picture Finders Limited may modify these terms from time to time and any such modification is effective immediately upon notice to you.
